On July 9, 2020, at 15:00-16:00 CEST, Davis Polk will be hosting a virtual event in partnership with Paris Arbitration Week. Partner Frances Bivens, counsel Jonathan Chang and Alexandre Vermynck and Columbia Law School Professor George A. Bermann will be among the speakers on Davis Polk’s panel, “When Your International Arbitration Becomes a U.S. Discovery Battle: A First-Hand Overview of Obtaining and Defending Against Discovery in the U.S.”

Under U.S. law, any person or entity “found” in the U.S. may be required by a U.S. federal court to provide documents or testimony for use “in a proceeding in a foreign or international tribunal.” The panel will provide an overview of the law, recent important developments that affect international arbitration practitioners and outline strategies for defending against efforts to obtain such discovery in the U.S.
