Summary

Crypto asset legislation is on the horizon. We have started to see legislative proposals, some of which are meant to create a regulatory framework for all crypto assets and others for certain classes of crypto assets such as stablecoins. We expect these proposals—even if not enacted in their current forms—to provide the building blocks for future proposals that ultimately become law.

House Financial Services Committee Chairman Patrick McHenry (R-NC), House Committee on Agriculture Chairman Glenn Thompson (R-PA), Subcommittee on Digital Assets, Financial Technology and Inclusion Chairman French Hill (R-AR) and Subcommittee on Commodity Markets, Digital Assets and Rural Development Chairman Dusty Johnson (R-SD) sent a letter to Treasury Secretary Janet Yellen in her capacity as Chair of the Financial Stability Oversight Council regarding regulatory gaps in the spot market for digital assets that are not securities.
