On September 20, 2023, Don Bernstein, emeritus Chair of Davis Polk’s Restructuring practice, and Tim Graulich, head of International Restructuring, will be among the speakers at Global Restructuring Review’s “GRR Live: Restructuring in the Americas” program. Don will co-chair the event and moderate the “Cross border insolvency cases — headwinds for recognition?” panel. Topics discussed will include differences in cross-class cramdown standards from country to country, newly introduced laws in European jurisdictions, further complications for recognition created by the Gibbs Rule and the impact of the Cayman Islands’ new restructuring officer regime.

Tim will moderate the “Post-insolvency finance” panel. Topics discussed will include the role of foreign lenders, the use of DIPs by foreign debtors in chapter 11 and interesting features of recent DIP facilities for LATAM companies.
