A discussion draft of legislation to regulate the over-the-counter (“OTC”) derivatives markets (the “Draft Bill”) was released on October 2, 2009 by House Financial Services Committee Chairman Barney Frank. The Draft Bill builds on the Obama Administration’s “Over-the-Counter Derivatives Markets Act of 2009” (the “Obama Proposal”) that was released on August 11.
