Victory for Vineyard Wind Project recognized in AmLaw “Litigator of the Week” column
A Davis Polk team led by Frances Bivens and Mike Scheinkman received runner-up honors in AmLaw Litigation Daily’s “Litigator of the Week” column for successfully securing a preliminary injunction order on behalf of Vineyard Wind, preventing GE Renewables from walking away from a major offshore wind project.
The Vineyard Wind project is a large commercial-scale wind project located off the coast of Nantucket, which is on the verge of bringing online 806 megawatts of renewable energy to Massachusetts in furtherance of the Commonwealth’s renewable energy mandate. The project is the first utility-scale offshore windfarm in the United States and its progress is being closely watched by the industry.
The column noted, “GE had indicated it intended to cease work on the project later this month, after not being paid for 18 months. But Vineyard Wind claimed that any payment due to GE is offset by damages caused to the project since a GE Haliade-X blade collapsed into the water in July 2024, resulting in a six-month construction delay as further issues with the blades surfaced. Massachusetts Superior Court Justice Peter Krupp last week granted Vineyard Wind’s preliminary injunction motion in full, finding ‘it does not appear that there was any amount due to GE.’”
The decision paves the way for project completion, five years in the making. The project is set to go online in a matter of weeks, bringing low-cost renewable energy to Massachusetts energy customers.
