Davis Polk partner and Restructuring practice co-head Marshall Huebner discussed Purdue Pharma’s chapter 11 restructuring proceedings and his experience working with Purdue’s general counsel Marc Kesselman in an interview with Law360.

“We [Davis Polk] were brought in, in 2018, to assess the situation and assist the company in going in a new direction,” Marshall said. “I am not sure that anyone has worked harder on this situation than Marc has for the last seven years.”

Marshall added that the case was “a very difficult, very painful, very fraught situation, and I don’t know of anyone on any side who does not respect Marc — from the government creditors to the victim groups to the official committee.”

He described Marc Kesselman as “the hardest working Eagle Scout in law. He and I have, for years, been on the phone at or after 11pm, probably three nights a week, week after week, about this very challenging and demanding case. Marc’s dedication and sheer appetite for incredibly hard work in very difficult situations is almost without parallel.”

Marshall noted that Marc took on a bankruptcy case “with complexities that virtually no other case has ever had. I really don’t know where we would be without him.”
