Davis Polk partner David Lisson was quoted in Bloomberg Law speaking on new guidance from the U.S. Patent and Trademark Office on AI-assisted inventions. The guidelines clarify that AI-assisted inventions can be eligible for a patent if a human was significantly involved in developing it.

Discussing potential litigation around AI-assisted inventions, David said, “Accused infringers will take a very hard look at what the AI was doing, versus the humans, and challenging whether that was enough.”
