Davis Polk partner and Supreme Court & Appellate practice head Kannon Shanmugam was honored as a runner-up this week in AmLaw Litigation Daily’s “Litigator of the Week” column for an unprecedented win in a challenge to a federal law that would have imposed price controls on Botox.

Kannon led the Davis Polk team representing manufacturer AbbVie in a bid to block the federal government from targeting Botox for price controls under the Medicare Drug Price Negotiation Program, which was established as part of the 2022 Inflation Reduction Act. 

U.S. District Judge Carl J. Nichols of the District of Columbia granted AbbVie’s motion for summary judgment in the case, holding that Botox falls within the statutory exclusion for plasma-derived products.
