Davis Polk partner and IP Litigation head Ashok Ramani was quoted in National Law Journal on IP litigation trends and trade secret suits. Ashok noted that he expects to see more trade secret suits in the coming years. “Funders seem to be moving away from patent cases to some degree,” he said. “They seem to really be focused on trade secret cases now.”

Ashok also added that trade secrets cases come with built-in narratives of betrayal and deception, something patent owners sometimes struggle to inject into their cases. “There’s the old saying that if you’re the plaintiff you want to win big but not too big [in patent cases],” Ashok explained. “Trade secret damages law, at least so far, has been more forgiving.”
