We secured a favorable settlement on behalf of Comcast

Davis Polk achieved a favorable settlement on behalf of Comcast while serving as lead counsel in patent litigation brought by Touchstream Technologies in the Eastern District of Texas.

Touchstream sued Comcast in February 2023, alleging infringement of three patents generally related to the remote control of video playback, and seeking over $550 million in damages. The plaintiff’s infringement allegations target the Xfinity TV Remote mobile application used with X1 set-top boxes.

Trial began on March 17, 2025 and, just before closing arguments on March 21, the court announced to the jury that the parties had reached a confidential settlement of the case. District Judge Rodney Gilstrap released the jury that morning and granted the parties’ joint motion to dismiss with prejudice that same day.
