We advised the committee following the abandonment of a multi-billion-dollar nuclear project

Davis Polk represented the Special Litigation Committee of the Board of Directors of SCANA Corporation, a South Carolina-based utility company, in the wake of SCANA’s high-profile abandonment of the multi-billion-dollar construction of two new nuclear units. We assisted the committee in its mandate to evaluate the allegations made against certain of SCANA’s officers and directors in various litigations arising out of the abandonment of the nuclear units, and to determine whether it was in the best interests of SCANA to pursue derivative claims or take other remedial action.

In January 2019, SCANA was acquired by Dominion Energy, Inc. The members of the Special Litigation Committee ceased to be members of SCANA’s Board of Directors at that time, and our representation came to a conclusion.
