On May 14, 2024, Davis Polk partner and national security practice head Paul Marquardt and counsel Matt Yeowart will be among the speakers at “CompLaw: FDI Regimes & Foreign Subsidies Regulation.”

Paul will speak on the “Outbound Investment and Technology Transfer: Beyond Wassenaar” panel, which will discuss Reverse CFIUS, emerging/foundational technologies and expanded use of the Entity List in the U.S.; white papers on outbound investments and export controls in the EU; and implementation of the 2023 Atlantic Declaration in the U.K.

Matt will speak on the “Foreign Subsidies Regulation in Practice” panel. Topics to be discussed include how the rules are bedding down and what the Commission has seen so far; when filings need to be made; collecting and reporting data on Foreign Financial Contributions; how the rules are applied substantively; applying the ‘fund exemption’ in practice for private equity clients; the use of ex officio investigations; how corporations are ensuring compliance, what difficulties corporations have encountered and how they are managing the process; and implications for investment, including how best to structure investments in light of the new regulation.
