Mr. Block is a partner in the Litigation Department, practicing in Northern California. His civil trial practice focuses on intellectual property and antitrust matters, and he has prevailed on behalf of both plaintiff and defense clients in cases tried to jury verdicts.

Mr. Block’s trial and hearing experience includes oral arguments in federal district and appeals courts on procedural and dispositive motions, as well as numerous successful direct and cross-examinations at trial. In addition to his live trial experience, Mr. Block has repeatedly been called on to prepare and present his clients’ adversaries’ cases as first-chair in jury exercises across the country. He has also frequently served as lead author on his clients’ most critical briefs, including at summary judgment, post-trial and on appeal.

Work Highlights

  • Comcast Corporation in patent litigations against Rovi Corporation (now part of TiVo) pending in multiple federal district courts, the International Trade Commission and the Court of Appeals for the Federal Circuit, in which Rovi has to date asserted 23 patents in its efforts to secure a renewal of Comcast’s portfolio license
  • Comcast Corp. in patent infringement lawsuits against Sprint Communications, encompassing over 30 patents asserted in federal courts across the country, including:
    • Obtained a jury verdict finding that Sprint infringed three Comcast patents in the District of Delaware, which the Federal Circuit affirmed
    • Secured a complete victory in the District of Delaware through summary judgement as to certain Sprint patents and judgment as a matter of law as to others, which the Federal Circuit summarily affirmed
    • Resolved dispute in the District of Kansas, in which Sprint sought close to $1 billion in damages
  • A major content distributor in various private disputes and regulatory proceedings related to compulsory copyright licensing under 17 U.S.C. § 111
  • The United States Golf Association in commercial and intellectual property disputes related to the USGA Handicap System™
  • T-Mobile USA in antitrust class action matters, including:
    • Won judgment defeating a $2.7 billion antitrust class action alleging price fixing in text messaging services
    • Successfully enforced arbitration rights and obtained favorable settlement in putative class action regarding “application-to-person” text messaging
  • Various representations of Boards, Committees and Directors in investigations and litigations related to fiduciary duty claims, including:
    • Individual directors of a Fortune 100 technology company in shareholder derivative litigation regarding an interested transaction
    • A Committee of the Board of a Fortune 500 technology company in an investigation of potential claims regarding a cyber-attack and data breach
  • Innolux Corporation in numerous class actions and opt-out suits involving attorneys general, direct purchasers and indirect purchasers in relation to horizontal price-fixing claims regarding TFT-LCD displays
