Davis Polk partner and Supreme Court & Appellate practice head Kannon Shanmugam received a shoutout in AmLaw Litigation Daily’s “Litigator of the Week” column for securing an appellate ruling affirming the dismissal of climate change-related claims brought by the City of New York under the Consumer Protection Law (CPL).

The column noted how New York’s Appellate Division, First Department held this week that the city’s product greenwashing claims failed since “the general public, regardless of level of sophistication, is now well aware of the fact that the use of fossil fuels results in greenhouse-gas emissions and is ‘the primary driver of climate change.’” The court further held that the company’s statements about their corporate practices—made solely for branding and public relations purposes and without connection to any goods or services—did not support a CPL claim.
