Davis Polk partner Ted Polubinski was quoted in Bloomberg Law discussing key securities litigation developments from the last year that are expected to shape securities cases in 2026.

The article highlights that appeals court rulings on investor class status, and efforts to prevent investors from achieving class status, will remain a key focus in 2026. Ted explained that the Second and Third circuits “have now taken different approaches” on the issue, and there’s an “emerging circuit split.”

Ted added that he expects more appellate considerations in 2026 and “would not be surprised if there were one or more” petitions to the top court.
