David Lisson discusses executive order on AI with New York City Bar Association Podcast
Davis Polk IP Litigation partner and head of the firm’s GenAI litigation initiative, David Lisson, was featured on an episode of the New York City Bar Association Podcast to discuss the recent executive order, “Ensuring a National Policy Framework for Artificial Intelligence.” The episode discusses the executive order’s key issues, implications and challenges, as well as state AI laws, potential federal restrictions on state funding, and the creation of an AI Litigation Task Force.
Delving into the executive order’s establishment of an AI Litigation Task Force and its implications, David shares that he thinks this task force will increase uncertainty for a while as litigation can take time, saying “a litigation task force that leads to litigation in the courts is not going to come up with any quick answers, leaving participants in the market a little bit in the dark for a while.” He also notes that there are “some questions about the basis on which they would bring any sort of case or challenge, how effective that will be [and] on what grounds does the federal government have the ability to challenge some of these laws.”
The podcast also explores why the executive order specially calls out Colorado’s AI law. David explains, “I think they identified Colorado specifically for two reasons. One, it was one of the first [states] to pass a comprehensive law.” The second reason, he says, is because it has a “substantive provision that I believe the executive order intends to target.” He adds that, “I think to the extent any state has similar provisions that the executive order is identifying will be subject to review.”
