Davis Polk partner Brian Burnovski was quoted in Bloomberg Law discussing the Ninth Circuit’s recent decision in Jaeger v. Zillow, in which the court denied Zillow’s request for a panel rehearing and rehearing en banc. The case asked the Ninth Circuit to consider the Supreme Court’s Goldman standard for certifying a stockholder class.

In discussing whether Zillow will ask the U.S. Supreme Court to review the decision, Brain said “I think there would be a lot of value in the Court providing additional clarity on its Goldman decision, though the Court also has a lot of other things on its plate these days.”

Brian added that Supreme Court review “would certainly be an opportunity to better explain the contours around when courts should find a mismatch between the alleged misstatement or omission and the alleged corrective disclosure.”
