Davis Polk partner Ben Joseloff was quoted in Foreign Investment Watch discussing a new form in the CFIUS Case Management System that allows filers to discuss matters with the Committee. 

The article noted that Chris Pilkerton, Assistant Secretary for Investment Security, has publicly stated that one of his objectives is to improve customer service and have CFIUS act in a more customer-centric fashion. 

“Assistant Secretary Pilkerton has been very clear about his goal to increase CFIUS’s focus on customer service and communication with stakeholders, and he has been equally vocal in encouraging parties to engage proactively with the Committee,” Ben said. “Implementing a more formalized pre-filing consultation mechanism is a great way to advance those objectives, particularly if it leads to meaningful, substantive dialogue between CFIUS and transaction parties.”

Davis Polk’s comment letter from March 18, 2026, responding to the request for information pertaining to the CFIUS Known Investor Program, was also cited. The letter states that the Committee should “formalize a pre-filing consultative mechanism … whereby parties that wish to engage in substantive consultations would provide certain limited but standardized information regarding the proposed transaction and the parties.”

The article noted, “Davis Polk specifically noted that the consultation can be facilitated through the CMS, which is exactly what the Committee has done.”
