Victory in wrongful conviction damages trial
Davis Polk achieved a favorable outcome for our client in the New York Court of Claims
Davis Polk represented our client in a trial in the New York Court of Claims in connection with claims for damages against the State of New York. Davis Polk’s client was wrongfully convicted of murder in 1993, a crime for which he was incarcerated for more than 25 years. In 2019, The Kings County District Attorney’s Office vacated our client’s conviction. In August 2022, a trial was held related to his Section 8(b) claim for damages. The case was tried before Judge Richard Sise, who sits on the New York State Court of Claims. In October 2023, the court ruled in favor of our client, finding that he had proven his innocence by clear and convincing evidence, and the parties subsequently reached a favorable settlement on damages.
