We advised the forward counterparties on the offering

Davis Polk acted as special product counsel to the forward counterparties in connection with DTE Energy Company’s SEC-registered at-the-market offering program. Pursuant to the terms of the program, DTE Energy may issue, offer and/or sell, including sales made pursuant to forward sales agreements, shares of its common stock, without par value, with an aggregate gross sales price of up to $1.5 billion.

In 1995, DTE Energy incorporated in the State of Michigan. DTE Energy is engaged in utility operations through its wholly owned subsidiaries, DTE Electric Company and DTE Gas Company. DTE Energy also has non-utility operations that are engaged in a variety of energy-related businesses.
