Davis Polk advised the sales agent in connection with an SEC-registered at-the-market offering by Boston Omaha Corporation of its shares of Class A common stock for up to an aggregate amount of $100 million. The Class A common stock is listed on the New York Stock Exchange under the symbol “BOC.”

Based in Omaha, Nebraska, Boston Omaha operates three separate lines of business: outdoor billboard advertising, surety insurance and broadband services. In addition, the company has recently started work on a new “build for rent” business. The company holds minority investments in commercial real estate management and brokerage services, a bank focused on servicing the automotive loan market, a residential homebuilding company with operations located primarily in the Southeast United States and a developer of private aviation infrastructure focused on building, leasing and managing business aviation hangars.
