Indian Competition Law - Annual Review (2011)
Most of today's global companies have Indian operations while others are looking to enter the Indian market through acquisitions or joint ventures. Both operations and entry/exit transactions need to comply with India's new Competition Law that was adopted in 2002 but enforced more recently in May, 2009. The Competition Law regime has been in effect for over a year covering anti-competitive agreements and abuse of dominance cases. Since June 2011, the combinations regulations have also been effective covering cross-border and domestic M&A transactions. This memorandum reviews recent experience with India's Competition Law and discusses some of the key headlines during 2011.
