Mr. Gehring is counsel in Davis Polk’s Litigation Department. He represents clients in a wide range of civil litigation matters, including complex commercial and contractual disputes, mass tort actions, professional liability suits, and class actions. He has represented major industrial manufacturers, utility providers, technology and media companies, accounting and law firms, and financial institutions, among other companies, at both the trial and appellate level, in both federal and state court. His practice also includes extensive arbitration work, as well as advising clients on litigation risk in connection with potential transactions and otherwise outside of actual litigation.

Work Highlights

  • Represent a major chemical company in a confidential arbitration concerning the sale of proprietary technology
  • Represent Block.one in securities litigation arising from the sale of the EOS cryptocurrency
  • Secured dismissal with prejudice for Corelle Brands in a putative class action alleging a product defect in Pyrex bakeware
  • Won dismissal with prejudice on behalf of Tezos Foundation, a Swiss foundation, in a first-of-its kind securities litigation relating to $232 million cryptocurrency fundraising
  • Achieved a complete victory for pharmaceutical company Roche in an action alleging antitrust violations in connection with the sale of multiple cancer drugs; dismissal affirmed on appeal
  • Secured a voluntary dismissal of breach of contract claims against two major financial institutions after moving to disqualify opposing counsel on the basis of a conflict
  • Represented Con Edison in:
    • Winning multiple dismissals at summary judgment in actions arising from service outages caused by Hurricane Sandy;
    • Defeating class certification on behalf of Staten Island in a related putative class action;
    • Winning dismissal on summary judgment in a related wrongful death action; dismissal affirmed on appeal
  • Served as trial counsel to an investment fund in a confidential arbitration alleging breach of contract by a former partner
  • Represented Bonanza Creek Energy in all aspects of its chapter 11 cases, including as trial counsel
  • Served as trial counsel to a large media company in a confidential arbitration against a telecom arising from an alleged breach of contract
  • Obtained a complete victory in the New York Court of Appeals for Civic Center Community Group Broadway LLC in a case involving the landmarking of 346 Broadway’s clock tower
  • Represented multiple major law firms in actions alleging malpractice in connection with transactional advice
  • Represented a major auditing firm in connection with alleged malpractice arising from tax advice provided to a client
  • Represented Baker Hughes in connection with appraisal and shareholder derivative actions in the Delaware Court of Chancery
  • Represented an elderly taxpayer pro bono in a lawsuit brought against him by the IRS for unpaid taxes
  • Represented a number of inmates pro bono in a lawsuit against the Westchester County Jail system for alleged First Amendment and other civil liberties violations
