Davis Polk Helps Pinnacle Airlines Gain Confirmation of Its Chapter 11 Plan of Reorganization

Davis Polk has served as lead counsel to Pinnacle Airlines Corp. and its subsidiaries throughout their approximately year-long chapter 11 proceedings. On April 17, 2013, Pinnacle Airlines’ Plan of Reorganization was confirmed by the Bankruptcy Court for the Southern District of New York. Davis Polk worked to successfully resolve all objections to the Plan in advance of the hearing, which was therefore uncontested. Pinnacle Airlines expects to emerge from bankruptcy on or about May 1, 2013, as a wholly owned subsidiary of Delta Air Lines, Inc., completing a successful restructuring.

Pinnacle Airlines is a regional airline that provides transportation between hubs and smaller outlying cities as a “Delta Connection” carrier, operating more than 1,000 daily flights to more than 100 cities in the United States and Canada. Pinnacle Airlines and its subsidiaries filed voluntary petitions for reorganization under Chapter 11 of the U.S. Bankruptcy Code on April 1, 2012.

The Davis Polk insolvency and restructuring team included partners Marshall S. Huebner and Damian S. Schaible and associates Darren S. Klein and Eric L. Ruiz. The litigation team included partners Benjamin S. Kaminetzky and Amelia T.R. Starr, counsel James I. McClammy and Lynn Earl Busath and associates Paul S. Mishkin, Daniel M. Loss, Jessica L. Freese, Marc J. Tobak, Lauren Howard Elbert, Stefani L. Johnson, Gerald M. Moody Jr. and Isaly S. Judd. Senior counsel Juliet Cain provided credit advice. Partner Kathleen L. Ferrell provided tax advice. All members of the Davis Polk team are based in the New York office.
