Davis Polk lawyers Timothy Graulich and Giorgio Bovenzi will be among the featured speakers at De Brauw Blackstone Westbroek’s upcoming seminar entitled, “The Dutch Scheme of Arrangement is coming - New restructuring opportunities abound.”
Tim and Giorgio will review the Continuity of Companies Act II (Wet continuïteit ondernemingen II), which went into public consultation in the Netherlands on August 14, 2014, from a U.S. perspective, providing comparative-law insight on the tools available under the U.S. Chapter 11 reorganization statute and addressing several cross-border insolvency and risk management aspects. They will also examine certain analogies and differences between the concepts and procedures adopted in the bill and U.S. restructuring practice. The bill is considered one of the most significant amendments proposed to the Dutch Bankruptcy Act in decades.
