Davis Polk partner Ronan Harty will be among the speakers at the GCR Live 6th Annual Antitrust Law Leaders Forum. Harty will speak on the "Merger: The Path Less Trodden" panel. Topics discussed will include:
- What types of evidence do agencies consider most significant in prevention of competition / actual potential competition cases? How should agencies assess whether the acquisition of a potential competitor is likely to have a substantial impact on competition?
- As more industries become concentrated, have efficiencies become a tool that merger practitioners more frequently deploy? Are evidentiary standards for assessing efficiencies evolving as efficiencies are asserted more frequently, and agencies develop more experience with their evaluation?
- Is “public interest” becoming a more common topic of discussion in merger control proceedings? Should it be a greater (or lesser) mode of analysis in merger matters?
