Davis Polk partners Donald Bernstein and Damian Schaible will be among the speakers at the 41st Annual Lawrence P. King and Charles Seligson Workshop on Bankruptcy & Business Reorganization, presented by the American Bankruptcy Institute and New York University School of Law in association with the Pollack Center for Law & Business.
Bernstein will speak on the "Secured Creditors and Absolute Priority" panel, which will include a discussion on the differences in methods of collateral valuation for adequate-protection and chapter 11 plan purposes, the post-petition effect of security interests, post-confirmation interest (including the ABI Commission’s proposal on the topic), and modification of absolute priority with the Commission’s proposed redemption option value distribution.
Schaible’s panel, “DIP Financing, Pre-Confirmation Sales and Out-of-Court Restructurings,” will cover debtor-in-possession financing, pre-confirmation sales with a focus on the ABI Commission’s proposed Section 363x and its rejected surcharge proposal, and Section 316b of the Trust Indenture Act. The program will be held September 16-17, 2015, in New York.
