We regularly represent companies in high-stakes products liability and mass tort cases and other class actions. These matters often are brought under a variety of contract, tort, antitrust and unfair competition theories. In addition, these matters regularly raise issues that extend beyond the legal defense at trial to the business effects on insurance coverage, financing, financial reporting, corporate governance, future corporate transactions and communications to shareholders – all areas in which our litigators have extensive experience.

Notable Matters

  • We successfully had Hyundai Heavy Industries, the manufacturer of the Deepwater Horizon oil rig, dropped from the federal multidistrict litigation arising out of the Gulf oil spill with no finding of liability and after paying no settlement amount, a tremendous victory for our client.

  • We served as national counsel to Pfizer in all Neurontin products liability and consumer-protection matters, defeating class certification in the MDL and in state courts and winning dismissal of a number of other purported class actions brought on behalf of classes of consumers and third-party payers.

  • We won dismissal of a putative nationwide class action brought in New Jersey federal court against our client Smith & Nephew, a manufacturer of orthopedic devices.

  • We have represented Consolidated Edison Company of New York, Inc. (“Con Edison”) in one of the largest consolidated litigations pending in the New York state courts, arising out of the July 18, 2007 steam pipe explosion in midtown Manhattan. The consolidated litigation includes major personal injury actions as well as cases brought by hundreds of businesses, which at the outset of the case sought nearly a billion dollars in lost profits and property damage.
