We regularly represent companies in high-stakes products liability and mass tort cases and other class actions, including consumer class actions. These matters often are brought under a variety of contract, tort, antitrust and unfair competition theories. In addition, these matters regularly raise issues that extend beyond the legal defense at trial to the business effects on insurance coverage, financing, financial reporting, corporate governance, future corporate transactions and communications to shareholders – all areas in which our litigators have extensive experience.

Notable Matters

  • We represent Hyundai Heavy Industries, the manufacturer of the Deepwater Horizon oil rig, in federal multidistrict litigation (MDL) arising out of the Gulf oil spill.


  • We represent Con Edison in actions arising out of the July 18, 2007 steam pipe explosion in midtown Manhattan. The consolidated litigation includes major personal injury actions as well as cases brought by hundreds of businesses seeking nearly a billion dollars in lost profits and property damage. 


  •  We won dismissal of a putative nationwide class action brought in New Jersey Federal Court against our client Smith & Nephew, a manufacturer of orthopedic devices, and a second orthopedic device manufacturer.


  • We successfully represented Pfizer in numerous consumer fraud class actions, including federal MDL, relating to the marketing of Neurontin. We defeated class certification in the MDL and in state courts and have won dismissal of a number of other purported class actions brought on behalf of national and state-wide classes of consumers and third-party payers.


  • We represented Con Edison in consolidated cases pending in New York State Court and regulatory proceedings arising out of power outages in Queens, New York in the summer of 2006.


  • We represented Exxon in three simultaneous federal and state grand jury investigations of alleged environmental violations relating to a major oil spill.


  • We represented Suzuki Motor Corporation in several product liability litigations relating to the Samurai sport utility vehicle, including obtaining the reversal of two multimillion dollar verdicts in the Supreme Court of Missouri, and brought a product disparagement lawsuit on Suzuki’s behalf against Consumers Union (CU) and its magazine Consumer Reports.


  • We represented ICI, a U.K. chemicals manufacturer, and several of its affiliates concerning litigation commenced by governments and individuals with respect to lead paint and lead pigment exposure.


  • We represent Altria in class action product liability litigation pending around the country relating to "light" cigarettes.
