Randall Guynn to Speak at ABA Webcast on New Orderly Liquidation Authority

Davis Polk partner Randall Guynn will be a panelist at “The Orderly Liquidation Authority: Bankruptcy by Another Name?,” a webcast being held by the American Bar Association’s Banking Law and Business Bankruptcy Committees on August 18, 2010.

The program – the second in a two-part series dedicated to the Dodd-Frank Wall Street Reform and Consumer Protection Act – will focus on understanding the new Orderly Liquidation Authority (OLA) that is designed to replace the bankruptcy courts in managing failing institutions that might be considered “too big to fail.” Among the topics panelists will address are the interplay of FDIC receivership law and bankruptcy law contained in the regulatory and liquidation components of the OLA; the structure and implementation provisions of the OLA; the claims distribution and priority system; and the impact of the new liquidation procedures on the implementation and enforcement of financial contracts, debentures and other financial instruments.
