New York, NY On September 24, 2009, Davis Polk partners Donald Bernstein, Karin Day and Jason Kyrwood and associate Brian Resnick presented “Credit Bidding: Does Your Vote Count?,” a seminar hosted by The Loan Syndications and Trading Association (LSTA). The seminar examined recent cases that have challenged certain assumptions about provisions protecting dissenting lenders, including in the context of an administrative agent’s right to credit bid for the assets of a borrower. The group also shared their experience and perspectives on the latest developments in this field.
