Davis Polk & Wardwell LLP advised Frontier Airlines Holdings, Inc. in connection with the confirmation of its Plan of Reorganization in the Bankruptcy Court for the Southern District of New York. Davis Polk worked to successfully resolve all objections to Frontier’s Plan in advance of the hearing, which was therefore uncontested. Frontier is set to emerge from bankruptcy on or about October 1, 2009, as a wholly owned subsidiary of Republic Airways Holdings, Inc.

Frontier Airlines is the second-largest jet service carrier at Denver International Airport and serves more than 50 destinations in the U.S., Mexico and Costa Rica. Frontier Airlines Holdings, Inc. and its subsidiaries (including Frontier Airlines) filed voluntary petitions for reorganization under Chapter 11 of the U.S. Bankruptcy Code on April 10, 2008. Frontier’s 17-month Chapter 11 restructuring has been a great success, with Frontier set to emerge as a leaner and stronger competitor when many analysts expected it to liquidate soon after its Chapter 11 filing last year.
